Buyer Terms & Conditions

1. Introduction

These Buyer Terms & Conditions govern all purchases made through GLD Commercial Auctions (“GLD”, “we”, “our” or “us”).

By registering to bid or placing a bid, you agree to these Terms.

2. Registration

All buyers must:

• Be at least 18 years of age.
• Provide accurate contact details.
• Supply identification if requested.
• Complete any verification checks required by GLD.

GLD reserves the right to refuse or suspend any account at its discretion.

3. Bidding

Every bid placed is legally binding.

By placing a bid you confirm that:

• You have sufficient funds available.
• You have read the lot description.
• You understand the asset is sold subject to these Terms.

Bids cannot normally be withdrawn once submitted.

4. Asset Information

Descriptions, photographs and videos are provided to assist buyers.

While GLD takes reasonable care when preparing listings, all assets are sold based on information supplied by the seller.

Buyers are encouraged to inspect assets before bidding where possible.

5. Winning the Auction

The highest accepted bid at the close of the auction will normally be the successful bid, subject to any reserve price.

GLD reserves the right to:

• Accept or reject bids.
• Extend an auction where necessary.
• Withdraw any lot.
• Correct obvious errors.

The decision of GLD is final.

6. Payment

Successful buyers must pay the full purchase price within the timeframe stated on the auction listing.

Payment must be be made using approved payment methods.

Ownership of the asset does not transfer until cleared funds have been received by GLD Commercial Auctions.

7. Risk

Risk in the asset passes to the buyer immediately upon collection of the asset.

8. Condition of Assets

Unless specifically stated otherwise:

• All assets are sold as seen.
• No warranty or guarantee is given.
• GLD makes no representation regarding condition, mileage, hours, roadworthiness, fitness for purpose or suitability.

Buyers should satisfy themselves as to the condition of the asset before placing a bid.

9. Default

If a buyer fails to complete payment or otherwise breaches these Terms, GLD may:

• Cancel the sale.
• Suspend or permanently close the buyer’s account.
• Offer the asset to another bidder.
• Recover any reasonable losses, costs or expenses incurred.

10. Identity Checks

GLD may request:

• Photographic identification.
• Proof of address.
• Company registration details.
• VAT information where applicable.

Failure to provide requested information may result in cancellation of the purchase.

11. Fraud Prevention

GLD reserves the right to refuse any transaction where fraud, money laundering or suspicious activity is suspected.

Where required, information may be shared with the appropriate authorities.

12. Limitation of Liability

GLD acts solely as an auction agent.

To the fullest extent permitted by law, GLD shall not be liable for:

• Mechanical faults.
• Hidden defects.
• Transport damage occurring after risk has passed.
• Inaccurate information supplied by sellers.
• Any indirect or consequential loss.

Nothing in these Terms limits liability where such limitation is prohibited by law.

13. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable UK data protection legislation.

14. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
